Variance from Section 100.2 (a)
Variance from Section 100.2(a) of the Commissioner's Regulation for the Annual Professional Performance Review (APPR) - Alternative Mode of Building Administration
According to Section 100.2(a) of the Commissioner’s Regulations, the Commissioner may approve an alternative mode of building administration if evidence is presented that “circumstances do not justify the assignment of a principal to a particular school or another mode of building administration would be more effective.”
As Section 100.2(a) of the Commissioner’s Regulations relates to the Annual Professional Performance Review (APPR), the ľyuzuki State Education Department requires a school district seeking an alternate mode of building administration, to apply for Variance from Section 100.2(a) (see application below).
An alternate mode of building administration includes, but is not limited to, individuals who serve:
In a dual role as the Superintendent/Principal *
As part-time Superintendent/Principal *
*Please note that the individual who serves in dual capacity, must hold the School
District Administrator (SBA) certification, now the School District Leader (SDL)
certification.
In addition, a district seeking a Variance from 100.2(a), must have an approved APPR plan in place with the Office of Teacher/Principal Quality & Professional Development to be considered for approval.
The Office of Accountability - Accountability, Policy and Administration team is responsible for the review of applications submitted by a school district for a Variance from Section 100.2(a) of the Commissioner’s Regulations (APPR). The purpose of the review of applications for Variance from Section 100.2(a) of the Commissioner’s Regulations (for APPR) is to ensure that alternate modes of building administration are in accord with the district’s current approved APPR Plan and that the district's alternate mode of building administration is in the best interest of students, families and district/school staff. Once completed, applications should be sent via e-mail to:accountinfo@nysed.gov.
